1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the website at www.casasindhu.in, the dealer portal at dealer.casasindhu.com, the tenant portal at tenant.casasindhu.com, and any related applications, features, and services (collectively, the "Platform") operated by CasaSindhu PropTech ("CasaSindhu", "we", "our", or "us"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and CasaSindhu under the Indian Contract Act, 1872, and the Information Technology Act, 2000.

2. Eligibility

To use our Platform, you must:
Age: Be at least 18 years of age and legally capable of entering into a binding contract under Indian law.
Accurate Information: Provide true, accurate, current, and complete information when submitting requirements or registering as a dealer.
Lawful Use: Use the Platform only for lawful purposes and in accordance with these Terms and applicable laws.
Authority: If registering on behalf of a company or firm (e.g., as a dealer), confirm that you are authorised to bind that entity to these Terms.

3. Our Services

CasaSindhu is a technology platform that connects tenants seeking rental homes with verified property dealers and listings. Our role and the scope of our services are as follows:
Facilitator, Not Landlord: CasaSindhu acts solely as an intermediary that facilitates connections between tenants and dealers/property owners. We are not a party to any rental agreement, lease, or transaction concluded between users.
Matching & Discovery: We use technology to match tenant requirements with available properties and to share verified requirements with dealers in the relevant area.
No Ownership of Listings: Property listings, prices, availability, and descriptions are provided by dealers and owners. We do not own, control, manage, or guarantee any listed property.
Support Services: We may facilitate property visits, negotiations, documentation, and rental agreement support. Such services are provided on a best-effort basis and do not create any liability for the outcome of a transaction.

4. Accounts & Verification

Certain features require identity verification or account registration.
OTP Authentication: We use OTP-based verification via WhatsApp or mobile number instead of passwords. You are responsible for keeping your verified number secure and for all activity conducted through it.
Dealer Accounts: Dealers must provide accurate business details, including company name, GSTIN, and address. We reserve the right to verify, approve, suspend, or reject any dealer account at our discretion.
Account Responsibility: You are responsible for all activity that occurs under your account or verified number. Notify us immediately of any unauthorised use.
No Sharing: You may not share, sell, or transfer your account access to any other person or entity.

5. User Obligations & Acceptable Use

When using the Platform, you agree NOT to:
Misrepresentation: Provide false, misleading, or fraudulent information, including fake listings, fake requirements, or impersonation of any person or entity.
Misuse of Data: Harvest, scrape, copy, or misuse contact details, listings, or any data obtained through the Platform for spam, marketing, or resale.
Circumvention: Bypass the Platform to avoid applicable fees, or solicit users to transact outside the Platform after being introduced through it.
Unlawful Conduct: Engage in any activity that is illegal, fraudulent, discriminatory, harassing, defamatory, or that violates the rights of others.
Technical Abuse: Introduce viruses, malware, bots, or attempt to gain unauthorised access to, disrupt, or overload the Platform or its infrastructure.
Intellectual Property: Reproduce, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

6. Property Listings & Transactions

All rental transactions take place directly between tenants and dealers/owners. Please note:
Independent Verification: While we make reasonable efforts to verify listings and dealers, you are responsible for independently verifying any property, its legal status, ownership, and the credentials of the other party before entering into any agreement.
No Guarantee: We do not guarantee the accuracy, completeness, availability, legality, or quality of any listing, property, or party. Listings may change or become unavailable without notice.
Rental Agreements: Any lease, rent, deposit, agreement, or obligation is solely between the tenant and the dealer/owner. CasaSindhu is not responsible for the performance, breach, or disputes arising from such agreements.
Due Diligence: You are advised to conduct physical inspections, verify documents, and seek independent legal advice before making any payment or commitment.

7. Fees & Payments

Certain services on the Platform may be subject to fees, brokerage, or charges.
Service Charges: Applicable fees, brokerage, or subscription charges (if any) will be communicated to you clearly before you incur them. By proceeding, you agree to pay such charges.
Brokerage Refund: Any brokerage refund, cashback, or promotional offer is subject to the specific terms, eligibility conditions, and timelines published for that offer, which may be updated from time to time.
Taxes: All fees are exclusive of applicable taxes (such as GST) unless stated otherwise. You are responsible for any taxes arising from your transactions.
No Refund Guarantee: Except where expressly stated in a published offer or required by law, fees paid for services are non-refundable.

8. Intellectual Property

All content on the Platform — including the CasaSindhu name, logo, design, text, graphics, software, and underlying technology — is the property of CasaSindhu PropTech or its licensors and is protected by Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. This licence does not permit you to copy, reproduce, modify, distribute, sell, or commercially exploit any part of the Platform without our prior written consent. Any feedback or suggestions you provide may be used by us without obligation or compensation to you.

9. Third-Party Services & Links

The Platform integrates with and may link to third-party services such as WhatsApp Business API, Google Maps, payment gateways, and external property portals. We are not responsible for the content, accuracy, availability, or practices of any third-party service. Your use of such services is governed by their respective terms and policies.

10. Disclaimers

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, CasaSindhu disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of viruses, or that any defects will be corrected. We make no representation regarding the conduct, reliability, or suitability of any tenant, dealer, or property owner using the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law:
No Indirect Damages: CasaSindhu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or opportunity, arising from your use of the Platform.
Transaction Disputes: We are not liable for any loss, damage, fraud, or dispute arising from rental agreements, payments, or dealings between tenants and dealers/owners introduced through the Platform.
Liability Cap: Our total aggregate liability for any claim arising out of or relating to the Platform shall not exceed the total amount of fees, if any, paid by you to CasaSindhu in the three (3) months preceding the event giving rise to the claim, or ₹1,000, whichever is lower.

12. Indemnification

You agree to indemnify, defend, and hold harmless CasaSindhu PropTech, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms or any applicable law; (c) your infringement of the rights of any third party; or (d) any transaction or dispute between you and another user.

13. Suspension & Termination

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Platform — in whole or in part — if we believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or otherwise pose a risk to the Platform or other users. You may stop using the Platform at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall continue to apply.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, India. Before initiating legal proceedings, the parties shall make good-faith efforts to resolve disputes amicably through negotiation.

15. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. When we make material changes, we will: • Update the "Last Updated" date at the top of this page • Notify you via WhatsApp or email if you have an active account • Display a notice on the Platform where appropriate Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CasaSindhu regarding the Platform.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
No Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
